Yes, in most cases. If you have assets in the UAE — including property, bank accounts, investments, or business interests — a UAE will or DIFC-registered will is essential. Without one, your UAE assets will be distributed according to UAE Personal Status Law, which may be very different from your home country's law and may not reflect your wishes. A foreign will is generally not automatically enforceable in the UAE without lengthy and expensive legal recognition procedures. Having a dedicated UAE will ensures your assets are distributed exactly as you intend.
The DIFC Wills and Probate Registry was established in 2015 to allow non-Muslims resident in or owning assets in the UAE to register wills and handle probate under a common law framework. It is open to non-Muslim individuals regardless of nationality. Registered DIFC wills are legally enforceable across the entire UAE and cover real estate, financial assets, business interests, and guardianship of minor children. The Registry provides certainty, efficiency, and the application of familiar common law principles to estate administration.
If a non-Muslim expatriate dies without a valid will in the UAE, their UAE assets will generally be distributed according to UAE Personal Status Law, which is based on Sharia principles. This can result in distributions very different from the deceased's wishes — for example, a surviving spouse may not automatically inherit the family home, unmarried partners receive nothing, and the distribution shares among children may differ significantly from what most expatriates would expect. The process is also typically lengthy, expensive, and emotionally draining for the family.
The duration varies significantly depending on whether there is a valid will and which court has jurisdiction. Uncontested DIFC probate with a registered will can typically be completed in 3–6 months. Probate in UAE mainland courts takes longer, often 6–18 months for straightforward cases. Contested estates or those involving multiple jurisdictions can take considerably longer — sometimes several years in complex litigation. Having a properly drafted DIFC will is the single most effective way to minimize probate delays.
Yes. Wills can be challenged in UAE courts on various grounds, including lack of testamentary capacity (the testator did not understand what they were doing), undue influence, fraud or forgery, failure to comply with formal execution requirements, or where the will is found to be contrary to public policy. DIFC-registered wills can be challenged in the DIFC Courts. Successfully contesting a will requires solid evidence, and the process is complex and expensive — which is why professional will drafting is so critical to prevent future challenges.
The most important step is to have a properly drafted DIFC will with specific provisions for your children's inheritance, including a testamentary trust to hold assets for minor children until they reach an appropriate age. You should also include guardianship provisions naming who will care for your minor children, review beneficiary designations on life insurance policies, and consider a DIFC or offshore trust for larger estates to provide structured, protected distributions over time rather than a single lump-sum payment at age 18 or 21.

The DIFC Wills and Probate Registry is exclusively available to non-Muslims. Muslim individuals in the UAE have their estates governed by UAE Personal Status Law based on Sharia principles. While Muslim testators can make a will for up to one-third of their estate (to non-heirs or for charitable purposes), the remaining two-thirds must be distributed according to Sharia rules of inheritance.
